Colaba Land Scam Worth Rs. 500 Crores sign now

Indian Army, India

Dear Sir,

1. Please refer to news item "Top generals, babus & netas in land-grab" published in The Times of India on 25th October, 2010. View online on: along with Reader Opinions.

2. On behalf of Mumbai Citizens Group and the undersigned citizens of Mumbai, we petition the Chief of Army Staff to hold an unbiased Court of Inquiry and investigate the various aspects as mentioned in this news item published and take action against the guilty officers. At the same time, it is requested the Chief of Army Staff may initiate proceedings to take over the land and building for use by Defence Authorities or for the Defence Forces personnel.

3. The entire nation considers you, The Army Chief, as a model of uprightness with great moral values, unimpeachable integrity and high level of discipline. We request you to rise upto the occasion and take immediate action on the matter.

4. This is a much more serious than the SUKNA LAND SCAM where disciplinary action was initiated against four generals for giving No Objection Certificate to a private developer to set up an educational trust and land in question was not owned, possessed and occupied by the Indian Army.

5. In the present case land was under uninterrupted and continuous possession of the Army for over 40 years. The said plot was a garden known as Khukri Eco Park with 135 grown up trees and was under the management of local military authorities. The GOC M& G Area Maj. Gen. B A Cariappa inaugurated the said park on 27th October, 1996 on the Infantry Day. The park was surrounded by a wall constructed by the Military Engineering Services and the same was adjacent and contiguous to other Army units located in the Zone VI. The said Eco Park continued to remain under control and management of Army till 2004 where army personnel were detailed round the clock regularly for guarding it like any other army establishment. 6. The land was abandoned by the Army to be allotted to Adarsh Co-operative Housing Society by a conspiracy hatched by senior serving officers, bureaucrats, politicians and officers of Defence Estate. The conspiracy was hatched in the year 2000 when Maj. Gen. A. R. Kumar was the General Officer Commanding MG & G Area and Brig T. K. Kaul was the Sub Area Commander. Brig T. K. Kaul came back as GOC MG & G Area in November 2002.

7. Since the year 2000, each of the Generals Officer Commanding, Maharashtra & Gujarat Area, Maj. Gen. A. R. Kumar, Maj. Gen. V. S. Yadav, Maj. Gen. T. K. Kaul, Maj. Gen. Tejinder Singh, Maj. Gen. R. K. Hooda, have become members of Adarsh Society for allotment of flat to them or their relatives as if it was a pre-requisite of the appointment of General Officer Commanding, Maharashtra & Gujarat Area and in return these General Officers remained silent on the conspiracy hatched even at the risk of the security hazard posed by construction of 30 storey building overlooking the sensitive defence area. Not only did they remain silent on this issue but provided immunity and protection to the Society in continuing their manipulation.

8. The 30 storeyed building constructed completely dominates the entire Army & Navy area and sensitive installations like Tata Institute of Fundamental Research. The building causes a security concerns of great magnitude in the longer run.

9. The Army & Navy in Mumbai are in great need of land to meet shortage of accommodation for its officers and other ranks. Presently, several other ranks are being made to share married accommodation. Sharing of married accommodation by more than one family has caused several social problems of privacy and illicit relationships.

We the citizens of Mumbai request you as under:
(a) Investigate the matter through a Court of Inquiry. Mumbai Citizens Group will be PLEASED TO PRESENT relevant and detailed facts to the Court of Inquiry so convened.

(b) Initiate necessary proceedings to recover the land and the assets so abandoned for use by the Army and obviate the security concerns.

(c) Intimate Govt. of Maharashtra, Collector of Mumbai and other statutory bodies not to grant Occupancy Certificate till the matter is FULLY investigated.

(d) Approach the Collector of Mumbai not to sign any lease document in respect of this plot with Adarsh Society, as it can be proved that the Army has the title of the land.

(e) Take necessary disciplinary action against the erring officers many of whom have suppressed and destroyed documents and records.

Indian Army is known for its discipline and uprightness. It is really a shame if the top brass of the Army is involved in such a murky deal!! Stern action against those involved is required to retain the respect and belief held on the army by the people o

If this land was developed to house war widows and veterans of Kargil, it makes the scam all the more dirty. It shows how deep the rot in the Army really is. But I am not surprised it was a matter of time before this got exposed.

This is downright scandalous - what makes it suspect is this curious mix of beneficiaries -- bureaucrats, their children, wives, even mothers-in-law of politicians AND the military.

The matter needs a much bigger investigation as it inlolves many from other Forces than Army as also prominent civilians not answerable to the COI by the Army.
