Justice From Wal-Mart sign now

I, Jacqueline Yvonne Elliott, am starting this petition in hopes of getting justice, fairness or even just an apology from the Wal-Mart Franchise in which I was employed at (store #0975) from July 15, 2003 to October 29, 2003. I am encouraging anyone and everyone to read a copy of the letter enclosed in this petition. Please read it all because I feel that every word is extremely significant to this situation. Besides sending an email and a postal letter to the Home Office, I also tried twice to reach Mike Snell, Store Manager of #0975 at Durant, OK; Buddy Sherrill, District Manager, and Tim Austin also in management through email. I have gotten no response from anyone to this day.

To Management:

I would like for this to be considered as a Letter of Complaint against Wal-Mart Store # 0975. I want to start out by saying I am a 54-year-old Licensed Practical Nurse who hurt my back in a fall while on vacation in October of 2001. I told Wal-Mart about this in my interview and my application. This in no way hampered my work and all members of management had access to this information. I never sat down on my job, but only on my breaks. The younger associates did sit at the desk. I say this only to let you know that I took my job very seriously and did my work professionally. And I did enjoy it also.My first day of work was July 15, 2003. My final day of work was October 29, 2003. My first and unfortunately my only evaluation was approximately the middle of October. My first supervisor was Susan Chalk. But shortly after I started, our department got a new supervisor, Alice. So Alice is the one who did my evaluation. She gave me an excellent rating on my evaluation. I was told that I was a valued employee and given a 4\% raise, which is the most you can receive on a first evaluation. My job included working the Fitting Room. This included helping customers in the Fitting Rooms, answering the 5 outside lines on the phone, paging customers and employees within the store and contacting all members of management on the walkie talkie radio when needed both within and outside the store, getting all returns from the Service Desk, Layaway, and the Fitting Room, and rehanging all clothing properly and scanning so they can be put back out in the softline departments for sale. I was also told by Susan Chalk that part of my job was to see that all the softline associates got their returns out on the floor before their shift or hours were over. And I had very little problem with this except for 2 girls, Casey Nix 19, and Jacky Wallace 17. The days I worked with these girls became unbearable most of the time because I couldnt get Jacky to do anything. And Casey would do very little after she started running with Jacky. They would say they were going to get their returns and then either not get them at all or just get a few. I would also notice that some of the things I would repair or hang would be either ripped back open or thrown behind some of the drawers we had back in that area. I first complained when I had been on my job for a couple of weeks or less. I couldnt get them to give me a break. Many days I only had my one-hour meal break for which I clocked out. It was up until the last day I worked there very difficult to get my two 15 minute breaks each day especially if it was up to Casey or Jacky to do it. I am not talking about the other evening softline associates. I can truthfully say that I loved working with Amanda, Jessica, Leslie, Monica, Sandy who is now an ICS team member, and Stephanie who is now a cashier. These little girls are all that made the job fun and bearable. Lots of times I would page Casey or Jacky 2 or 3 times to come to the Fitting Room and they would not respond in any way. But if I paged them for an outside call, they would come running. And every time before answering the phone line, Jacky would ask, Is it a boy or a girl? Like that should make a difference. I complained and talked with management several times. I first talked with Susan Chalk under what I thought was the Open Door Policy and found out a few days later she had actually used my name in the next Softline meeting. And I was under the assumption that the Open Door Policy operated with confidentiality, but there was none used in my case. I had 3 of the associates tell me that my name was given out at the meeting. Needless to say I would not tell someone else to use the Open Door Policy if they wanted to say something they didnt want repeated over the store. Susan Chalk also told me that day that this was definitely not the first time there had been complaints against Jacky Wallace. She told me this when I told her that I had seen Jacky on several occasions just standing, kind of stooped over trying not to be seen and doing absolutely nothing. Other times I have seen Jacky standing and talking with high school friends for up to 25 minutes at a time while all the other associates are working and actually earning their money. I know this because after I started noticing her doing this a few times, I started checking the time on my watch. The next time I went and talked to Chris Tubbs just about 4 weeks ago. He told me he was taking notes so he could get with Mike Snell and figure out what could be done. Nothing was done as far as I know. There was certainly no changes. And I was told why by several associates. And yes, there are many associates who have complained about Jacky. They said the reason nothing will be done is because her mother works there, in Accounting I believe. On October 29, 2003, between 9:00 and 9:30 pm, Casey and Jacky came by the Fitting Room and said they were going to take their last break. Well they were only working from 5:00 pm to 10:00 pm. Just 5 hours. They had their first break around 7:30 pm. I told them they only had one 15-minute break for 5 hours. They both started arguing with me that they got two 15-minute breaks for 5 hours. And whats more, another associate had told Jacky that just 3 days before. Then Jacky said, I have a letter from Susan Chalk saying I get two 15 minute breaks for 5 hours. They then went to management and asked how many breaks you got on 5 1/2 hours work. I heard Management tell them one 15-minute break over the walkie-talkie radio. Then Casey and Jacky came back by the Fitting Room and Casey kept walking toward her department but she said under her breath, Im getting tired of this! This is stupid, Bitch! I told her, Youre right Casey, this is stupid. Its stupid that you and Jacky expect to get 2 breaks when the rest of us are lucky to get one. By this time Casey was over in her department laughing at me and talking to a woman who was standing there. I called management and Gary Buchanan answered. I told him that I needed someone to come to the Fitting Room to relieve me. I told him it was almost time for the softline girls to leave and Casey and Jacky each had a big box of returns. I also said they had done absolutely nothing all night. I was in the Fitting Room with a cart full of my own returns and those boxes had been there all night right in front of them and I heard one ask what would they do with those two boxes and the other one said, She, meaning me, can scan and hang them and the night crew or morning can have them. I told Buchanan what was going on and he said, Im coming back there. Well about 2 or 3 minutes later I heard screaming going on at the back of the store where the time clocks are. While this is going on, Casey comes up and gets in my face right in front of a lady customer who is in the front fitting room and starts mouthing me. I was so upset, I didn't even know what she was saying to me at that point. I finally told her, Casey get out of here. If you dont get out of here, I am calling management and telling them you are harassing me. Then Casey yelled, Im damn harassing you? You dont even know what harassment is! And she walked off. To me, this sounded like a threat. The lady came out of the fitting room and I apologized to her and she said, No problem, Ive worked in these kind of stores. I know what its like. I was so flustered that I did not even think to get her name or phone number as a witness. I did not even think I would need it as I thought that management would at least want to hear my side of it. But apparently Assistant Manager Gary Buchanan did not care to hear my side even though I had witnesses for all of what went on.At this point, Buchanan came up and just stood there with his hand on his hip staring at me. I could tell my Blood Pressure was way up because I felt like I was going to faint and I was noticeably shaking. I told him, Ive got to get out of here. I cant take this right now. He never once asked for my side of anything. He just got on the walkie-talkie and said, I need a cashier back to the Fitting Room. Whoever he spoke to asked why and he said, Because Lavonne is quitting. My name was right on my nametag and there was no mistaking how it was spelled. I had the feeling that he was mispronouncing my name on purpose. What's more, I never said I was quitting. I just knew I had to get home and calm down. But when Buchanan said that, I just started for the back of the store. I sat down in the lounge in shock for a few minutes. Then I thought, If Im not working here anymore Id better clock out. And thats what I did. Then Buchanan came and took me into the training room and put his hand on his hip again and said, So, what are we looking at here? And I said, Well, since you announced all over the store on the walkie-talkie that Im quitting, then I guess Im quitting. He didnt say a word but walked over and got a piece of paper and I dont know what he wrote or what was on the paper. He just told me to sign it and I was so upset and shaking so hard I could barely scratch my name down. I wasnt told what the paper was or even offered a copy of it. Even now I dont know what I signed. When I got home 90 minutes later my blood pressure was 198/102. I am a very hard worker and as I told management several times I did love my job. Even when it was at its most hectic I still enjoyed it. Casey told Leslie in the Infants Dept. and I that she is only staying until February when she will get her bonus check. She told us she heard it might be as much as several hundred or up to a thousand dollars. Then she asked Leslie if Applebees Restaurant in Sherman, Texas paid well and if the tips would be good. Another thing, Casey has already put in for Christmas and Thanksgiving off and the days before and after each holiday also. I heard her say that even if its not approved, she is just going to call in sick. I am 54 years old and I had intended to work at Wal-Mart till I retired. As I have said I enjoyed my job and I loved most of the young ladies I worked with and I believe they liked me too. Because almost every one of them called or told me when I last saw them that they really hated to see me go and that they had enjoyed working with me. I really believe you would be hard pressed to get someone to say the same thing about Jacky or Casey because everyone complained about the girls' work. Even the night shift and the morning shift complained about the work that was left for them to do after these two went home. These were the only two that I had a real problem with. And 3 different people told me that Jacky and Casey had actually planned to try to get rid of me. I dont understand the logic in what happened here. And I do want you to consider this a Letter of Complaint, because I know this was very unfair and I believe the way this was handled was not professional or legal.Thank you for your time.
